OVERVIEW
This website is operated by Lion Wild. Throughout these Terms, “Lion Wild”, “we”, “us” and “our” refer to Lion Wild.
By visiting lionwild.com.au, using our website or purchasing from us, you agree to these Terms of Service (“Terms”), together with any policies referred to in them.
Please read these Terms before using our website. If you do not agree with them, please do not use the website or purchase from us.
Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to sell our products to you.
1. USING OUR ONLINE STORE
You must use our website and products only for lawful purposes.
You must not use the website in a way that infringes the rights of another person, interferes with the operation or security of the website, introduces malicious code, attempts unauthorised access, or breaches any applicable law.
We may restrict or suspend access to the website where reasonably necessary for security, maintenance, suspected fraud, misuse or legal compliance.
2. PRODUCTS
We make every reasonable effort to accurately display and describe our jewellery, including colours, finishes, measurements, materials and product imagery.
Colours and finishes may appear slightly different depending on your device, screen settings, lighting and photography.
Because many Lion Wild pieces are handmade, plated or feature natural or individually finished details, small variations may occur between pieces.
Product availability and quantities may change without notice.
Nothing in this section limits any rights you may have where a product does not match its description, sample or other consumer guarantees under the Australian Consumer Law.
3. PRICES
Prices are displayed in the currency shown on the website and may change from time to time.
The price applicable to your order is the price displayed when you place the order, subject to any obvious pricing or technical error.
If we discover a material pricing or listing error after you place an order, we will contact you as soon as reasonably possible. Where appropriate, we may give you the option to proceed at the correct price or cancel the affected item for a refund.
Any cancellation or correction will be handled subject to applicable law.
4. ORDERS
Submitting an order does not guarantee that every item will be available.
We may need to cancel or adjust an order where, for example:
• an item is unexpectedly unavailable
• there is an obvious pricing or listing error
• payment cannot be authorised
• an order appears fraudulent or unauthorised
• fulfilment would breach applicable law
If we cancel an item that you have already paid for, we will refund the amount paid for that item using the appropriate payment method.
We may apply reasonable purchase limits to products or promotions where necessary to manage limited stock, prevent misuse or ensure fair access.
You are responsible for providing accurate contact, billing and delivery information when placing your order.
5. PAYMENT
Payments are processed through Shopify and/or the payment methods made available at checkout.
You agree to provide current and accurate payment and billing information.
We do not directly store complete credit card details submitted through Shopify’s secure payment systems.
6. PRE-ORDERS
Some Lion Wild products may be offered for pre-order before stock is ready to dispatch.
Any expected dispatch date shown for a pre-order is an estimate and may change due to production, freight or circumstances outside our reasonable control.
If a pre-order is materially delayed, we will endeavour to provide updated information where appropriate.
Your rights under the Australian Consumer Law continue to apply to pre-order purchases.
7. SHIPPING + DELIVERY
Australian and international delivery information, estimated timeframes, tracking and other shipping details are set out in our Shipping + Delivery page and Shipping Policy.
Delivery timeframes are estimates and may be affected by Australia Post, international carriers, customs, peak periods, weather or other circumstances outside our reasonable control.
International customers may be responsible for customs charges, import duties, taxes or other fees imposed by their destination country.
Please check your delivery details carefully before submitting your order and contact us as soon as possible if you notice an error.
8. RETURNS, CHANGE OF MIND + CONSUMER RIGHTS
Our voluntary change-of-mind return conditions are explained in our Returns + Exchanges Policy.
Eligible change-of-mind returns are issued as a Lion Wild gift card in accordance with that policy.
Our change-of-mind policy is separate from your rights under the Australian Consumer Law.
Our goods come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
If a product is faulty, damaged, unsafe, does not match its description or otherwise fails to meet an applicable consumer guarantee, you may be entitled to a remedy including repair, replacement, refund or compensation depending on the circumstances and the nature of the failure.
Nothing in these Terms or any Lion Wild policy excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified.
9. GIFT CARDS + PROMOTIONS
Gift cards, discount codes, promotional offers, competitions and other incentives may be subject to additional conditions displayed at the time of the offer.
Promotional codes generally cannot be exchanged for cash and may be subject to eligibility requirements, expiry dates, exclusions or minimum spend requirements where stated.
Where a promotion has specific terms, those terms apply in addition to these Terms.
Nothing in promotional conditions limits rights available under applicable consumer law.
10. ACCURACY OF WEBSITE INFORMATION
We make reasonable efforts to keep the website accurate and current.
Occasionally, information may contain an error or omission relating to product descriptions, pricing, promotions, stock availability, shipping information or other content.
We may correct genuine errors and update website information where reasonably necessary, subject to our obligations under applicable law.
11. THIRD-PARTY SERVICES + LINKS
Our website may use or link to third-party services, applications, payment providers, social platforms and websites.
Third-party services may have their own terms and privacy policies.
We are not responsible for the content or practices of independent third-party websites that we do not control.
Your use of third-party services is also subject to any terms that apply between you and that provider.
12. REVIEWS, COMMENTS + USER CONTENT
If you submit a review, photo, comment or other content to Lion Wild, you confirm that you have the right to provide that content and that it does not infringe another person’s rights or contain unlawful, misleading, abusive or malicious material.
Where you submit content for publication, you grant Lion Wild permission to use, reproduce and display that content in connection with our business, website, marketing and social channels, subject to applicable privacy and consumer laws.
We may moderate or remove content where reasonably necessary, including where it is unlawful, misleading, offensive, spam, unrelated or infringes another person’s rights.
13. INTELLECTUAL PROPERTY
Unless otherwise stated, the Lion Wild website and its content, including branding, logos, product designs, photographs, graphics, text and other original materials, are owned by or licensed to Lion Wild.
You may use the website for personal shopping and informational purposes.
You must not reproduce, commercially exploit, copy or distribute our protected content without permission, except where permitted by law.
14. PRIVACY
Your personal information is handled in accordance with our Privacy Policy.
By providing personal information through our website, you acknowledge that it will be handled as described in that policy and in accordance with applicable privacy laws.
15. WEBSITE AVAILABILITY
We aim to keep our website available and operating correctly, but we cannot guarantee uninterrupted access at all times.
The website may occasionally be unavailable because of maintenance, technical issues, platform outages or circumstances outside our reasonable control.
We may update, change or discontinue website functionality where reasonably necessary.
16. LIABILITY + AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.
To the extent permitted by law, Lion Wild is not responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.
Any limitation of liability in these Terms applies only to the extent permitted by law and does not affect your statutory consumer rights.

You must not use the website:
• for unlawful or fraudulent purposes
• to infringe intellectual property or other legal rights
• to distribute malware or malicious code
• to interfere with website security or functionality
• to obtain unauthorised access to systems or information
• to scrape, spam, phish or misuse the website
• to submit deliberately false or misleading information
• to harass, threaten or unlawfully discriminate against another person
We may take reasonable steps to protect the website, our customers and our business where these Terms are breached.
18. SEVERABILITY
If any part of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or severed to the extent necessary while the remaining provisions continue to apply.

Changes will apply from the date the updated Terms are published and will not remove rights that have already arisen under applicable law.

Nothing in this section restricts any rights you may have under applicable Australian consumer law.
